1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of WonderVibe (the "Platform"), operated by New American Enterprises, LLC ("we," "us," or "our"). By creating an account or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

2. Account Creation

To submit content or interact with the community, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your password and accept responsibility for all activity under your account.
• Be at least 13 years of age. Accounts for users under 18 require parental consent.
• Not create multiple accounts to circumvent bans or restrictions.
• Notify us immediately at hello@wondervibe.ai of any unauthorized use of your account.

3. Acceptable Use

You agree not to use the Platform to:

• Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Submit malware, spyware, ransomware, or any code designed to harm users or their systems.
• Infringe on any third party's intellectual property, privacy, or other rights.
• Spam, phish, or engage in any deceptive practices.
• Attempt to gain unauthorized access to other accounts or the Platform's infrastructure.
• Use the Platform for any commercial purpose not expressly permitted by us.
• Scrape, crawl, or use automated means to access the Platform without prior written consent.

We reserve the right to remove any content and suspend any account that violates these guidelines, at our sole discretion, without prior notice.

4. Content Ownership & License

You retain all ownership rights to the content you submit to WonderVibe, including apps, skills, prompts, descriptions, and screenshots ("Your Content").

By submitting content to WonderVibe, you grant New American Enterprises, LLC a non-exclusive, worldwide, royalty-free, sublicensable license to host, display, distribute, reproduce, and promote Your Content solely for the purpose of operating and improving the Platform.

If you mark your submission as "forkable," you additionally grant other users a license to copy and build upon Your Content for non-commercial purposes, with attribution.

You represent and warrant that you have all necessary rights to grant the above licenses, and that Your Content does not violate any law or third-party rights.

5. DMCA & Copyright

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on WonderVibe infringes your copyright, please submit a takedown notice per our DMCA Policy.

Repeat infringers will have their accounts terminated.

6. Termination

We may suspend or terminate your account and access to the Platform at our sole discretion, with or without cause, and with or without notice.

You may delete your account at any time by contacting us at hello@wondervibe.ai. Upon termination, your license to use the Platform ends immediately. Content you posted may remain on the Platform unless you request deletion, subject to any legal obligations we have to retain it.

7. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. All user-submitted content is screened but not guaranteed to be safe. Use any downloaded code at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEW AMERICAN ENTERPRISES, LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.
