DMCA Policy

1. Overview

New American Enterprises, LLC ("we," "us," or "our") respects the intellectual property rights of others and expects users of WonderVibe to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (17 U.S.C. § 512) ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our Platform.

If you believe that content on WonderVibe infringes your copyright, you may submit a DMCA takedown notice to our designated agent as described below.

2. Filing a Takedown Notice

To file a DMCA takedown notice, send a written communication to our designated copyright agent (contact information in Section 6) via email with the subject line: "DMCA Takedown Notice".

Upon receipt of a valid, complete notice, we will:

  • Remove or disable access to the allegedly infringing content within a reasonable time.
  • Notify the user who posted the content of the takedown.
  • Provide the user an opportunity to submit a counter-notification.
Warning: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorneys' fees.

3. Required Information

Your takedown notice must include all of the following to be valid under 17 U.S.C. § 512(c)(3):

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list.
  2. Identification of the infringing material: A description of the material you claim is infringing and that you want removed, with sufficient detail that we can locate it on the Platform (e.g., the URL of the submission).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
  6. Signature: A physical or electronic signature of the person authorized to act on behalf of the copyright owner.

4. Counter-Notification

If you believe your content was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification with our designated agent. Your counter-notification must include:

  1. Your full legal name, mailing address, telephone number, and email address.
  2. Identification of the material that was removed and the location where it appeared before removal (e.g., the URL).
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the District of Delaware if your address is outside the United States), and that you will accept service of process from the person who filed the original takedown notice.
  5. Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action, we may restore the removed content at our discretion.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers.

A user who receives two or more valid DMCA takedown notices within any 12-month period will have their account suspended or permanently terminated. We also reserve the right to terminate accounts of users who, in our sole judgment, abuse the submission process or engage in willful copyright infringement.
